EU-Verordnung 2023/988 über die allgemeine Produktsicherheit (GPSR)

In 2023, the EU adopted a new regulation that defines general safety and quality standards for products marketed in the EU. This regulation comes into force on 13 December 2024.

Who is the Regulation Relevant for?

Auch für Wirtschaftsakteure in Bezug auf Medizinprodukte gilt ab dem 13.12.2024 die GPSR – diese sind nicht aus dem Anwendungsbereich ausgeschlossen.

Die Anforderungen der GPSR greifen immer dann, wenn in der Eurpopäischen Medical Device Regulation (MDR) keine spezifischeren Anforderungen definiert wurden. Weiterhin ist nach wie vor ein Entwurf zur Änderung unseres nationalen Produktsicherheitsgesetzes (ProdSG) in der Bearbeitung, um diese EU-Verordnung auch in nationales Recht zu überführen.

What Aspects Should Economic Operators or Manufacturers Consider?

For you as an economic operator or, if applicable, a manufacturer of medical devices, requirements in the following areas, in particular, must be taken into account and implemented in addition to the MDR:

• Specific obligations of economic operators with regard to distance selling
  • Werden Medizinprodukte online oder über eine andere Form des Fernabsatzes auf dem Markt bereitgestellt, so muss das Angebot die im Artikel 19, „GPSR“ festgelegten Angaben enthalten

• Special obligations of online marketplace providers in connection with product safety
  • Anbieter von Online-Marktplätzen müssen sich beim Safety-Gate-Portal registrieren und hinterlegen dort Ihre Angaben
  • A central point of contact for consumers regarding product safety issues is to be set up.
  • Reported information about dangerous products that you receive via the Safety Gate portal must be taken into account and action taken if necessary.
  • Reports must be processed immediately, and in any case within three working days.
  • Online-Marktplätze sind so zu gestalten, dass Verbrauchern für jedes angebotene Produkte die in Absatz 9 Artikel 22, „GPSR“ geforderten Informationen bereitgestellt werden können
  • Informationen zu gefährlichen Produkten sind über das Safety-Business-Gateway an die Martküberwachungsbehörden zu melden (Artikel 26, „GPSR“)

• Unterrichtung der Verbraucher über die Produktsicherheit durch Wirtschaftsakteure und Anbieter von Online-Marktplätzen (Artikel 35 „GPSR“)
  • Economic operators and providers of online marketplaces with product registration systems or customer loyalty programmes that enable the identification of products purchased by customers for purposes other than providing safety information to their customers shall provide their customers with the option of registering separate contact details for safety purposes only.

• Abhilfemaßnahmen im Falle eines Produktsicherheitsrückruf (Artikel 37 „GPSR“)
  • In the event of a recall, the responsible economic operator shall offer the consumer a choice between at least two of the following remedies:
    • Repair of the recalled product,
    • Replacement of the recalled product with a safe product of the same type, of at least the same value and quality, or
    • Reimbursement of the value of the recalled product, provided that the reimbursement amount is at least equal to the price paid by the consumer.
